2. Client Responsibilities
Clients are responsible for providing accurate and complete information, content, images, logos, credentials, and other materials required to complete a project.
The client agrees to:
- Provide required information and materials within a reasonable time.
- Ensure that all supplied content is legally owned or properly licensed.
- Provide accurate instructions and feedback.
- Review and approve project work when requested.
- Maintain appropriate backups of their website and business data unless backup services are specifically included in the project.
- Ensure that information supplied to Digital Web Service does not violate any applicable law or third-party rights.
Delays caused by missing information, delayed feedback, or failure to provide required access may affect the agreed project deadline.
3. Project Scope
Before starting a project, Digital Web Service may agree with the client on the project’s scope, features, functionality, design requirements, and deliverables.
Work outside the agreed scope may be considered additional work and may require additional charges.
Requests for major changes, additional pages, new functionality, or substantial redesigns after approval of the original scope may result in revised pricing and delivery times.
4. Pricing and Payment
Project pricing will be communicated to the client before work begins.
Depending on the project, Digital Web Service may require an advance payment or deposit before starting development.
For larger projects, payments may be divided into milestones.
The client agrees to make payments according to the agreed payment schedule. Digital Web Service reserves the right to pause work or withhold final delivery if an agreed payment is overdue.
Any third-party costs, including but not limited to domain names, hosting, premium themes, plugins, software licenses, APIs, advertising budgets, stock images, or other external services, may be charged separately unless specifically included in the project quotation.
5. Website Development
Digital Web Service will make reasonable efforts to develop websites according to the agreed specifications.
However, website performance and functionality may be affected by third-party hosting providers, plugins, themes, APIs, software updates, browsers, servers, or other external technologies.
We cannot guarantee that every third-party service or integration will remain available or compatible indefinitely.
For WordPress websites, compatibility may be affected by future WordPress core, theme, or plugin updates.
For Laravel websites, functionality may depend on the server environment, PHP version, frameworks, packages, APIs, and other third-party technologies.
6. Revisions and Changes
The number of revisions included in a project, if applicable, will be agreed upon before development begins.
Minor revisions within the agreed project scope may be included.
Significant changes to the original requirements, design, functionality, or project structure may incur additional charges.
The project timeline may also be extended when substantial revisions or additional requirements are requested.
7. Content and Copyright
The client is responsible for ensuring that all text, images, videos, logos, graphics, documents, trademarks, and other materials supplied to Digital Web Service are legally permitted for use.
The client agrees not to provide copyrighted or otherwise protected material without appropriate authorization.
Digital Web Service is not responsible for copyright, trademark, licensing, or other legal issues arising from materials supplied by the client.
Unless otherwise agreed in writing, the client retains ownership of the original content they provide.
Digital Web Service retains ownership of its own pre-existing code, development methods, tools, frameworks, reusable components, and intellectual property.
8. Third-Party Services
Some projects may require third-party products or services such as hosting providers, domain registrars, plugins, themes, payment gateways, APIs, email services, analytics platforms, advertising platforms, or other software.
Digital Web Service is not responsible for changes, interruptions, price increases, security issues, restrictions, or termination of third-party services.
Where third-party licenses are required, the client may be responsible for purchasing or maintaining those licenses unless otherwise agreed.
9. Digital Marketing and SEO
Digital marketing and SEO services are intended to improve online visibility, traffic, engagement, leads, or other agreed marketing objectives.
However, Digital Web Service does not guarantee specific search engine rankings, traffic levels, sales, leads, conversions, or revenue.
Search engines and advertising platforms regularly change their algorithms, policies, ranking systems, and advertising requirements. Such changes may affect campaign or SEO performance.
Advertising budgets paid to platforms such as search engines or social media networks are separate from Digital Web Service’s service fees unless explicitly stated otherwise.
10. Website Maintenance and Support
If maintenance or support services are included in the client’s package, the scope of support will be based on the agreed service plan.
Support may include updates, troubleshooting, minor changes, security checks, backups, or other agreed services.
Major development work, new features, redesigns, or functionality changes may be charged separately.
11. Delivery and Approval
Digital Web Service will make reasonable efforts to deliver projects within the agreed timeframe.
The delivery date may change due to circumstances including delayed client feedback, missing content, changes to requirements, third-party service issues, technical problems, or circumstances beyond our reasonable control.
The client is responsible for reviewing the completed work and notifying Digital Web Service of any issues within a reasonable period.
12. Cancellation of Services
Either party may request cancellation of a project or service subject to the terms of the individual agreement.
If a client cancels a project after work has started, payment may be required for work already completed, services already provided, and non-refundable third-party expenses.
Any refund, where applicable, will be handled according to the agreed refund policy.
13. Refunds
Refund eligibility depends on the nature of the service, the work already completed, and the terms agreed with the client.
Because website development and digital marketing services involve time, resources, and customized work, completed services and certain payments may not be refundable.
For more information, please refer to our Refund and Return Policy.
14. Security
Digital Web Service will take reasonable steps to provide secure and professional development services.
However, no website, server, software, or online system can be guaranteed to be completely secure.
The client is responsible for maintaining secure passwords and access credentials and should use reputable hosting, plugins, themes, and third-party services.
We are not responsible for security incidents caused by compromised third-party services, insecure hosting environments, weak passwords, unauthorized access, or modifications made by parties outside our control.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Digital Web Service shall not be liable for indirect, incidental, special, consequential, or business-related losses resulting from the use of our services or website.
This may include loss of profits, revenue, business opportunities, data, customers, or website availability.
Our liability, where legally applicable, will be limited to the amount paid by the client for the specific service giving rise to the claim, unless otherwise required by law.
16. Website Availability
We make reasonable efforts to keep our website accessible and operational. However, we do not guarantee uninterrupted or error-free availability.
Our website may occasionally be unavailable because of maintenance, updates, hosting issues, technical problems, security measures, or circumstances beyond our control.

You agree not to use our website or services for unlawful, fraudulent, abusive, harmful, or malicious activities.
You must not use our services to create or distribute content that violates applicable laws or infringes the rights of others.
Digital Web Service reserves the right to refuse or terminate services where there is a reasonable concern regarding illegal, fraudulent, abusive, or unethical use.
18. Confidentiality
Digital Web Service will make reasonable efforts to keep confidential business and project information provided by clients.
We will not intentionally disclose confidential information to third parties except where necessary to provide an agreed service, comply with legal obligations, protect our rights, or where disclosure has been authorized by the client.
19. Portfolio and Promotional Use
Unless otherwise agreed in writing, Digital Web Service may display completed website projects in its portfolio, website, social media, or promotional materials for the purpose of demonstrating our work.
Clients who do not want their project used for promotional purposes may request otherwise in writing.
20. Changes to These Terms
Digital Web Service reserves the right to update or modify these Terms & Conditions from time to time.
Any changes will be posted on this page with an updated “Last Updated” date.
Your continued use of our website or services after changes are posted constitutes acceptance of the updated terms.
21. Governing Law
These Terms & Conditions shall be interpreted and governed in accordance with the applicable laws and regulations of the jurisdiction in which Digital Web Service operates, unless otherwise agreed in writing.
Any disputes should first be addressed through good-faith communication between Digital Web Service and the client before pursuing other legal remedies.
